These Terms and Conditions ( “Terms” ) contain the terms upon which you may use our therapy referral website (“Website”) in order to book therapy with or provide therapy to other users of the Website.
The terms “we”,”us”,”our” and “ours” when used in these Terms of Business ( Terms ) to mean Borders, a trading name of Borders Counselling and Coaching Limited, a company incorporated in Scotland, registered company number SC389306 whose registered address is Leader Cottage, Nether Blainslie, Galashiels, TD1 2PR
The terms “Client(s)”, “Therapist(s)” “user(s)” “you”, “your” and “yours” when used in these Terms mean any user of the Website seeking to receive or provide Therapy Services.
YOUR USE OF THE WEBSITE
Purpose of Borders Website: The Website is a referral service, connecting clients with professional counsellors, psychologists and psychotherapists.
We will provide and maintain the Website in order to connect Clients and Therapists. You expressly agree that we are not party to any contract actually entered into between any Client and Therapist for the provision of Therapy Services.
Borders is a referral service and not a provider of therapy, counselling or other professional services and the relationship and legal contract for the provisions of these services are between the client and the therapist with whom the client books his or her session.
Both the Client and the Therapist must use the Website content and the Website Services responsibly. If the Client is in any doubt over a health issue, the Client should seek the advice of their GP. The Client must always follow the guidance and advice accompanying any Website content or any Website Services. It is the clinical responsibility of the Therapist to advise the Client on clinical matters.
This Website provides a profile webpage of the Therapist to assist the Client in making an informed decision as to whether or not they may benefit from the Clinical Services of the Therapist. The Client understands that the information contained within the Therapist’s profile webpage on the Website has been provided by the Therapist.
This Website has not been evaluated by any government or official body.
By using the Website you warrant that you are aged over 18 years.
By accessing any part of this Website, you indicate that you accept these Terms. If you do not accept these Terms of Use, you must leave this Website immediately.
You are responsible for making all arrangements necessary for you to have access to the Website. You are also responsible for ensuring that all persons who access the Website through your Internet connection or use your account are aware of these Terms and that they comply with them.
CONTENT
The content on the Website is provided for general information purposes only and is intended to be complimentary but not in any way a substitute for professional advice or treatment. Nor should the content be relied upon for the diagnosis or treatment of a mental or medical condition. If you seek such advice or treatment you should consult with a registered Therapist or Medical Practitioner.
Opinions expressed on the Website are solely the opinions of the Therapists or other authors of such material posted or appearing on the Website. Borders Counselling does not endorse any information, material, or opinion that may be posted on the Website.
Borders does not assume any liability or responsibility for damages or injury to persons or property arising from the use of any information or material of any nature provided on the Website.
THERAPISTS
Borders requires all Therapists to provide proof of qualifications, membership of an appropriate professional body and professional indemnity insurance, such as is required to conduct their private practice within their area of expertise, before listing on the Website, but Borders does not endorse or recommend any Therapist on the Website.
Therapists are not employees or agents of Borders, and if you choose to interact with a Therapist, your relationship is strictly with the Therapist. Borders assumes no responsibility for any act or omission of any Therapist.
Please note that once your booking has been confirmed, should you cancel we may charge you a cancellation fee depending on the circumstances of the cancellation, the timing of the cancelation and the value or nature of the session(s) involved.
COMPLAINTS
Client support is our top priority. In the event that you are dissatisfied with a session facilitated through this Website, you are able to lodge a formal complaint, Please note that any complaint must be lodged with our customer care team using the method described below within 48 hours of the session with the Therapist.
Any complaints should be made in writing by using the Contact Us page on the Website, giving full details required by Borders to substantiate your claims regarding the session, including the date, payment method and Therapist information.
Borders will investigate any complaints lodged within 7 days and report the outcome to you of their investigation.
Borders has complete discretion to refund up to the total amount charged by the Therapist for the session you are unhappy with, following completion of their investigation.
Borders may also, at its discretion, remove a Therapist subject to a complaint, following the completion of an investigation.
SERVICE ACCESS
Borders makes every effort to ensure this Website is available twenty four (24) hours a day, however they will not be liable if this Website is unavailable at any time or for any period.
Access to this Website may be suspended temporarily and without notice.
Should you and your Therapist be unable to conduct a pre-booked instant chat session due to the Website being unavailable, Borders will endeavour to reschedule your consultation with the same Therapist. Should rescheduling not be possible then You will be refunded in full for such sessions.
USER MATERIAL AND CONDUCT
Other than personally identifiable information, which is covered under the Privacy Policy, any material you transmit or post to this Website will be considered non-confidential and non-proprietary. Borders will have no obligations with respect to such material. Borders and anyone we designate will be free to copy, disclose, distribute, incorporate and otherwise use that material and all data, images, sounds, text and other things embodied in it for any and all commercial or non-commercial purposes.
You may not misuse the Website (including by hacking).
You release and undertake to hold harmless Borders, its directors, officers, employees, agents, successors, advisors, consultants, and assigns from any and all liability or causes of action and claims of any nature resulting from the acts of a Therapists accesses through the Website.

Links to third party websites on this Website are provided only for your convenience. If you use these links, you leave this Website. Borders has not reviewed all of these third party websites and do not control (and are not responsible for these websites or their content or availability). Borders does not endorse or make any representation about them, the material on them, or the results from using them. If you decide to access any of the third party websites linked to this Website, you do so entirely at your own risk.
You may link to this Website homepage, provided that you do so in a fair and legal way which does not damage Border’s reputation or take advantage of it.

Borders and the Therapists’ total liability to you in relation to your use of the Website and the services of the Therapists including (but not limited) to liability for breach of these Terms and tort (including but not limited to negligence) is limited to an amount equivalent to the total fees paid for consultations in the past 3 months.

Borders is committed to protecting your privacy and security. All personal data that we collect from you will be processed in accordance with our Privacy Policy. You should review our Privacy Policy, which is incorporated into these Terms by this reference and is available here.
You undertake not use the Website for any purposes which would violate any laws, impersonate another person, or engage in any other conduct which, in the opinion of Borders inhibits or restrict others from using and enjoying the services.
If any provision or part of a provision of these Terms is found by any court or authority of competent jurisdiction to be unlawful, otherwise invalid or unenforceable, such provisions or part provisions will be struck out of these Terms and the remainder of these
Website Terms will apply as if the offending provision or part provision had never been agreed.
Any failure or delay by you or Borders in enforcing (in whole or in part) any provision of these Terms will not be interpreted as a waiver of your or our rights or remedies.
Borders may transfer any of its rights or obligations under these Terms without your prior written consent to any business that Borders enters into a joint venture with, purchase or are sold to.
GOVERNING LAW AND JURISDICTION
These terms shall be governed by and construed in accordance with UK law. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the UK courts.
